1. Description of the Service

NicheQuill is a software-as-a-service platform that uses artificial intelligence to assist users in researching book niches, planning, drafting, and formatting non-fiction ebooks intended for self-publishing (for example, on Amazon Kindle Direct Publishing, "KDP"). NicheQuill provides tools for niche research, book planning, chapter drafting, cover generation, metadata generation, and export of a publication-ready package (EPUB, DOCX, cover image, metadata, and a compliance summary).

NicheQuill does not publish books on your behalf, does not guarantee acceptance by Amazon KDP or any other platform, and does not guarantee any level of sales, royalties, or income.

2. Accounts and Eligibility

• You must provide a valid email address to create an account. That email becomes your login identifier.
• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use NicheQuill.
• You are responsible for keeping your password confidential and for all activity that occurs under your account.
• You agree to provide accurate information and to promptly correct it if it changes.
• We reserve the right to refuse service, suspend, or terminate an account at our discretion, including for violation of these Terms.

3. Ebook Credits, Payments and Billing

NicheQuill operates on a prepaid "ebook credit" model rather than a recurring subscription:

• Each ebook credit entitles you to generate one full book (the complete chapter set for one project). Once a project's chapters have been generated for the first time, that project is considered "activated" and can be freely edited, rewritten, and re-exported without consuming additional credits.
• Ebook credits are purchased in packages, at the prices displayed at the time of purchase, and do not expire.
• Payments are processed by third-party payment providers, currently Stripe and/or WarriorPlus. NicheQuill does not directly collect or store your full payment card details.
• Prices are shown and charged in US Dollars (USD) unless otherwise stated. You are responsible for any currency conversion fees charged by your bank or card issuer.
• Some purchases may be made through affiliate links; this does not change the price you pay.
• We reserve the right to change the price of ebook credit packages at any time for future purchases. Changes do not affect credits already purchased.

4. Refund and Cancellation Policy

• We offer a 14-day money-back guarantee from the date of purchase, subject to the conditions below.
• To request a refund, contact us at mlbrand.ltd@gmail.com within 14 days of your purchase, referencing your payment receipt.
• Upon a refund being issued, your account access to generate new content is revoked. Content you have already generated and downloaded remains yours, but continued use of the platform to generate additional content is not permitted after a refund.
• We reserve the right to deny refund requests that show evidence of abuse (for example, requesting a refund after having consumed all purchased ebook credits).
• If you are a consumer located in the European Union, United Kingdom, or another jurisdiction that grants a statutory right of withdrawal for online purchases, nothing in this section limits any non-waivable right you have under applicable law.

5. AI-Generated Content and No Guarantee of Results

• Content generated through NicheQuill — including but not limited to niche research, book plans, chapter text, cover images, and metadata — is produced using third-party artificial intelligence models. This content may contain errors, inaccuracies, outdated information, or unintentionally similar phrasing to other works.
• You are solely responsible for reviewing, fact-checking, editing, and verifying the originality of any content before publishing it.
• Estimates shown in the niche research module (demand, competition, profitability, and revenue ranges) are automatically generated approximations for informational purposes only. They are not guarantees of sales, income, or market performance of any kind.
• NicheQuill makes no claim, express or implied, that using the platform will result in a published book, a successful listing, sales, royalties, or any specific outcome.

6. Your Responsibility for Amazon KDP Compliance

• You are solely responsible for complying with the content and publishing policies of Amazon KDP or any other platform you choose to publish on, including current requirements to disclose AI-generated or AI-assisted content.
• NicheQuill tracks basic disclosure flags (such as whether text, images, or translations were AI-generated) to help you complete these disclosures, but you remain responsible for accurately reporting them during upload.
• NicheQuill does not submit, upload, or publish content to Amazon KDP or any other platform on your behalf.

7. Content Ownership and License

• As between you and NicheQuill, you own the output generated for your projects (text, cover images, and metadata), subject to the underlying terms of the AI providers used to generate it and to applicable copyright law regarding AI-generated works, which varies by jurisdiction.
• You grant NicheQuill a limited license to store, process, and transmit your project content as necessary to operate the Service (for example, to generate, edit, export, and deliver your files, and to run automated quality and duplicate-content checks across your own projects).
• We do not claim ownership of your book content and will not sell or publish it ourselves.

8. Acceptable Use

You agree not to use NicheQuill to generate, request, or attempt to generate content that:

• Promotes hatred, discrimination, or violence against individuals or groups on the basis of race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or any other protected characteristic;
• Depicts, encourages, or provides instructions for violence, terrorism, or serious physical harm to any person;
• Sexually exploits or endangers minors in any way;
• Is defamatory, harassing, or intended to threaten a specific individual;
• Infringes the intellectual property, privacy, or other legal rights of any third party;
• Promotes self-harm, suicide, or dangerous illegal activity;
• Is otherwise illegal under applicable law.

This restriction also reflects the usage policies of the third-party AI providers (including OpenAI) that power NicheQuill; violating it may also violate their policies. We reserve the right to remove content and suspend or terminate accounts that violate this section, without refund, and may report unlawful content to relevant authorities where required.

You additionally agree not to:

• Attempt to circumvent usage limits, ebook credit requirements, or security measures of the Service;
• Use automated means (bots, scripts) to access the Service outside of its intended interface without our written permission;
• Resell, sublicense, or provide access to your NicheQuill account to third parties in a manner that violates these Terms;
• Misrepresent AI-generated content as entirely human-written where such disclosure is legally required.

9. Third-Party Services

NicheQuill relies on third-party providers to operate, including but not limited to: OpenAI (content and image generation), Stripe and WarriorPlus (payment processing), Brevo (transactional email), Cloudflare (file storage), and Railway (hosting and database infrastructure). Your use of NicheQuill is also subject to the applicable terms of these providers where relevant. We are not responsible for outages, errors, or policy changes originating from these third-party providers.

10. Intellectual Property of NicheQuill

The NicheQuill name, logo, interface design, and underlying software are the property of ML Brand and may not be copied, reproduced, or used without our prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICHEQUILL AND ML BRAND LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO NICHEQUILL IN THE 12 MONTHS PRECEDING THE CLAIM. Nothing in this section limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless NicheQuill and ML Brand from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your published content, or your violation of these Terms.

14. Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service. You may stop using NicheQuill at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.

15. Changes to the Service or these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date on this page. Continued use of NicheQuill after changes take effect constitutes acceptance of the revised Terms. We may also modify, suspend, or discontinue any part of the Service at any time.

16. Governing Law and Disputes

These Terms are governed by the laws applicable in the jurisdiction where ML Brand is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your own country of residence grant you additional rights that cannot be waived.
